On 14 July 2026, the Solomianskyi District Court of Kyiv closed the proceedings brought by Alexander Varvarenko, Varamar Shipping DMCC against Konstantin Kalnyi. The court concluded that the dispute should be considered within Ukraine’s commercial court system.

The decision of the Solomianskyi District Court of Kyiv to close the proceedings today, 14 July 2026, in the claim brought by Alexander Varvarenko, Varamar Shipping DMCC appears to be a logical procedural outcome.

From the outset, the claimants selected the wrong legal strategy. Their attempt to transform a commercial chartering dispute into a case concerning the protection of personal honour and dignity before a court of general jurisdiction appeared more like an emotional pressure tactic than a properly structured commercial claim.

The Ukrainian court made its position clear: disputes of this nature between business entities fall within the jurisdiction of the Commercial Courts.

The lawyers may continue the process

Given Mr Varvarenko’s apparent unwillingness to acknowledge any error and his particular approach to disputes, his lawyers may now rewrite the claim and submit it to the Commercial Court of Kyiv.

For the legal team, this would mean another proceeding, additional hearings and further professional fees, while maintaining the appearance of an ongoing legal battle.

The central issue will remain unchanged

A new filing will not remove the key fact behind the conflict.

Instead of resolving the underlying commercial dispute through the contractual framework, English law or recognised maritime procedures, a so-called personal “WhatsApp fine” was imposed against the broker.

Before a Commercial Court, the claimant may be required to demonstrate actual losses suffered by a legal entity rather than rely primarily on allegations of personal offence. That may be considerably more difficult, particularly against the background of documented claims concerning the outstanding brokerage commission.

The reputational dispute continues

The reputational show may continue, but the initiative has now shifted.

The maritime market has already seen that the first attempt by Alexander Varvarenko, Varamar Shipping DMCC to pursue the case before the ordinary civil court ended with the proceedings being closed.

The next questions are clear:

  • Will the claimants submit a new case to the Commercial Court of Kyiv?
  • Will they appeal the court’s decision and extend the procedural dispute?
  • How will international shipping and technology platforms, including SHIPNEXT, react as information about the court outcome circulates through the market?

The first judicial round is over.

The wider dispute is not.
