Charter Party Support

Kiev Shipping provides commercial charter party support for cargo interests, charterers, shipowners and operators during voyage charter negotiations and fixture finalisation.

Our role

Our role is to help ensure that the commercial terms agreed during negotiations are correctly reflected in the recap, charter party form and rider clauses, and that the final wording remains consistent with the fixture agreed between the parties.

We act as independent shipbrokers. Our support is commercial and operational in nature and is provided as part of the chartering process.

What We Support

We assist with voyage charter negotiations and charter party preparation, including:

  • GENCON and other commonly used voyage charter party forms;
  • review of fixture recaps;
  • checking consistency between the agreed recap and final charter party wording;
  • rider clauses and additional commercial terms;
  • freight and payment terms;
  • laycan and cancellation provisions;
  • loading and discharging terms;
  • laytime and demurrage provisions;
  • Notice of Readiness and commencement of laytime;
  • commissions and address commissions;
  • cargo and vessel requirements;
  • port and berth restrictions;
  • documentation and operational clauses;
  • communication between Charterers and Owners during fixing.

The purpose is to reduce inconsistencies between what was commercially agreed during negotiations and what later appears in the final charter party.

Recap and Rider Clauses

The fixture recap is one of the most important documents in the chartering process.

Once the main commercial terms have been agreed, the charter party and rider clauses should accurately reflect that agreement.

A rider clause can materially change the commercial position if it introduces new obligations, exceptions or restrictions that were not clearly agreed during the negotiation.

We therefore review the relevant wording against the recap and highlight points that may require clarification between the parties before the fixture is considered fully documented.

This may include issues relating to:

  • cargo quantity and tolerance;
  • freight payment;
  • loading and discharging rates;
  • working and non-working time;
  • demurrage;
  • NOR;
  • vessel gear;
  • draft and port limitations;
  • cargo documentation;
  • agency;
  • commissions;
  • other voyage-specific terms.

Support During the Fixture

Charter party support is not limited to the final document.

During negotiations, Kiev Shipping can assist with:

  • exchange of offers and counteroffers;
  • clarification of commercial terms;
  • subjects and lifting of subjects;
  • confirmation of vessel and cargo requirements;
  • coordination between Charterers and Owners;
  • preparation of the final recap;
  • follow-up until clean fixture;
  • finalisation of the agreed charter party wording.

The objective is to keep the commercial negotiation clear and to avoid unnecessary misunderstandings after the vessel has been fixed.

What Is Not Included

Kiev Shipping provides commercial shipbroking and chartering support.

We do not provide legal advice, legal opinions or court representation, and we do not act as legal counsel.

Where a charter party dispute requires formal legal interpretation, arbitration support or legal representation, the parties should instruct qualified maritime lawyers or other appropriate specialists.

Our role is to support the commercial fixture, communication between the parties and accurate reflection of the agreed terms.
